Private FDRs and Early Neutral Evaluation

As a barrister specialising in the financial consequences of relationship breakdown, Duncan is able to act as the evaluator or tribunal in private FDRs and Early Neutral Evaluations. Duncan is qualified to act as the evaluator in all three practice areas: Financial Remedies cases on divorce as well as chancery cohabitation disputes and Schedule 1 cases – all three strands are equally suited to pFDRs and ENE.

What can you expect from me as your evaluator? I will give reasoned indications in plain language addressing each of the points on which the parties are apart. Where applicable, I will endeavour always to give those indications orally but also backed by a written document for the parties to keep to aide negotiation. I will also aim to provide a net effect calculation to demonstrate the consequences of the indications given and with what each party will be left.

I am a passionate advocate for private FDRs and ENE. They have been described by one eminent KC as the ‘jewel in the crown’ of family law – a sentiment I endorse. I also believe wholeheartedly that parties have the right to know and understand the basis on which indications are given when it is their case and their financial future at stake. Where legal principles underpin indications, I will always try to explain them in plain language and in a way that can be readily understood by all parties (whatever their prior experience of the law).
